Digital Millennium Copyright Act Notice

If you believe that content available by means of the Website (as defined in our Terms of Service) infringes one or more of your copyrights, please notify us by providing a written notice ("Infringement Notice") containing the information described below to the designated agent listed below. If Yushino takes action in response to an Infringement Notice, it will make a good faith attempt to contact the party that made such content available by means of the most recent email address, if any, provided by such party to Yushino.
Your Infringement Notice may be forwarded to the party that made the content available or to third parties such as ChillingEffects.org.
Please be advised that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is infringing your copyrights. Thus, if you are not sure content located on or linked-to by the Website infringes your copyright, you should consider first contacting an attorney.

Please follow these steps to file a notice:

Contact the user directly. Go to the content in question and send a comment with your complaint to the user that posted to see if the matter can be resolved directly between you and that user.
Send your complaint to our designated agent. If the issue cannot be resolved directly with the user, send your complaint to our designated agent at (we prefer email):

You must include the following:

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
An identification of the copyright claimed to have been infringed;
A description of the nature and exact location of the content that you claim to infringe your copyright, in sufficient detail to permit Yushino to find and positively identify that content; for example we require a link to the specific post (not just the name of the user) that contains the content and a description of which specific portion of the user post - an image, a link, the text, etc – your complaint refers to;
Your name, address, telephone number and email address; and
A statement by you: (a) that you believe in good faith that the use of the content that you claim to infringe your copyright is not authorized by law, or by the copyright owner or such owner's agent; (b) that all of the information contained in your Infringement Notice is accurate, and (c) under penalty of perjury, that you are either the copyright owner or a person authorized to act on their behalf.
Once proper infringement notification is received by the Designated Agent, it is Yushino's policy to remove or disable access to the infringing Content and to notify the Content provider or User that it has removed or disabled access to the Content; that repeat offenders will have the infringing Content removed from the Services and that Yushino will terminate such content provider's or User's access to the Services.

In the event that Yushino notifies User that Yushino has received proper infringement notification about User's Content, User may elect to send Yushino a counter notice. Please note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.

The process for counter-notifications is governed by Section 512(g) of the Digital Millennium
Copyright Act: http://www.copyright.gov/legislation/dmca.pdf. To file a counter notification with Yushino, User must provide the following items to us in writing:

1. The specific URLs of material that Yushino has removed or to which Yushino has disabled access.
2. User's name, address, telephone number, and email address.
3. A statement that User consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or New York County, New York if your address is outside of the United States), and that User will accept service of process from the person who provided notification under subsection (c)(1)© or an agent of such person.
4. The following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
5. User's signature.

After we receive User's counter-notification, we will forward it to the party who submitted the original claim of copyright infringement. Please note that when we forward the counter-notification, it includes User's personal information. By submitting a counter-notification, User consents to having User's information revealed in this way. We will not forward the counter-notification to any party other than the original claimant. After we send out the counter-notification, the claimant must notify us within ten (10) days that he or she has filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on Yushino. If we receive such notification we will not display, distribute or otherwise exploit the material. If we do not receive such notification, we may elect to do so.
